By submitting your booking form and providing payment you are deemed to have read and understood the relevant baggage transfer terms and conditions. Please let Mont Blanc Bags know if you have any queries in relation to the information.
Upon completion of a booking with Mont Blanc Bags you are in acceptance of the following terms and conditions:
The client must make every effort to provide accurate information at all stages of the order.
Mont Blanc Bags will not be held responsible for luggage delivered to incorrect properties due to incorrect address’s provided by you the client.
Booking is effective when Mont Blanc Bags accepts from you a completed booking form with payment.
Email reminders asking for your accommodation selections, will be sent out periodically if you have not chosen your accommodations for your bag(s) to be collected. If this is not completed 72 hours before the initial collection date of your Tour du Mont blanc, then cancellation of booking will be made by Mont Blanc Bags at full cost.
Credit Cards will be will debited online at the point of booking,
Full payment is required at the time of booking unless an alternative arrangement has been made with Mont Blanc Bags.
Bookings made via Mont Blanc Bags website must be paid by credit/debit card using the online secure payment system.
Mont Blanc Bags will provide written confirmation of the booking in the form of an invoice via email to the address provided by you the client.
2. Cancellation, refunds and amendments
To cancel your order, email: firstname.lastname@example.org and include your order number.
Clients are entitled to cancel their booking up to 14 days prior to the first collection date with a full refund minus bank charges (3%).
For any cancellations made under 14 days prior to first collection date, there will be no refund.
Mont Blanc Bags can use its discretion to refund bookings cancelled under exceptional circumstances. In this case, the booking will be subject to an administration fee of 3% to the total value of the booking.
If a cancellation takes place once you have commenced your booked arrangements with Mont Blanc Bags, no partial refunds or credit will be given for services not used. Travel insurance should be instigated at the time of booking.
The payment fee is non-refundable, unless Mont Blanc Bags, due to causes beyond its control, cancels the booking.
As per French law article L121-20-04 Consumer Protection, the 7-day withdrawal notice is not applicable to the present terms and conditions. Therefore, the order will be firm, definitive and irrevocable.
If Mont Blanc Bags cancels a transfer for any reason other than extreme weather conditions and Force Majeure, then a full refund will be issued.
The baggage collection and drop off times set by MBB are calculated using normal conditions, however, because of the risk of high volumes of traffic and/or adverse weather conditions. MBB will endeavour to carry the all baggage to the destinations in timely fashion. However, due to circumstances beyond our control this may not be possible. This would include:
Accidents causing to delays to the vehicle
Exceptional or severe weather conditions
Compliance with police request
Unforeseen traffic delays
Industrial action by 3rd parties
Problems arising from other customers
Force Majeure (war, civil unrest, terrorism, acts of god, extreme weather conditions such as snow etc)
If affected by any of the above situations or other unforeseen event, MBB will make every effort to deliver the baggage to their destination. In the event when this is not possible, then Mont Blanc Bags cannot be held responsible for any losses or costs incurred.
Mont Blanc Bags reserves the right to outsource/sub contract bookings to other such licensed companies. Please note that their Terms and Conditions might vary.
In case of failure of use service/ bags are incorrectly labelled on their scheduled pick up date, the booking cost shall not be refunded.
Mont Blanc Bags reserves the right to update, add to or remove accommodation from their supported accommodation list at any time.
3. Conditions for modifying/amending a booking under 3 days prior to initial collection or during your tour:
If you wish to make amendments to your baggage transfer service under 3 days prior to initial collection date or during your tour, you must notify Mont Blanc Bags by email at: email@example.com
Last minute changes will incur a cost of €5 per amendment.
Any amendments to a booking must be made no later than 3 days prior to your first collection of luggage.
Mont Blanc Bags realises that changes to a client’s itinerary might well need to be made on the day of collection/drop off of luggage due to injury etc. We will endeavour to assist with these extra ordinary circumstances.
In the event that the customers failure to inform Mont Blanc Bags results in financial loss to Mont Blanc Bags, then Mont Blanc Bags reserves the right to charge an additional fee to the customer reflecting that loss.
Each bag has a weight limit of 18kg and a size limit of 80cm in length, width or depth.
Mont Blanc Bags reserves the right to charge an excess/additional baggage fee or to refuse to transport bags over the above weight limit.
“Over-sized” baggage (e.g. above the 18 kg allowance) may be authorised, subject to being clearly stated at the moment of booking and provided that there is space available in the vehicle.
In the event that extra/oversized baggage has not be declared at the time of booking, Mont Blanc Bags can refuse transportation if there is not enough available space in the vehicle. It is then up to the passenger to organise their own baggage transport.
All baggage must be secure, and clients must clearly label all their baggage with the tags provided by Mont Blanc Bags.
Mont Blanc Bags does not accept to transport luggage valued above 800 euros.
Mont Blanc Bags does not accept baggage which contains materials which are dangerous, flammable or likely to harm the safety of the drivers.
Under no circumstances may dangerous articles such as firearms, explosives, oxygen or combustible or illegal substances be in baggage. Mont Blanc Bags refuses the right and delegates the right to its drivers, to refuse to carry luggage thought to contain such items.
Mont Blanc Bags shall not be responsible for damage to fragile items.
5. Pick up and drop off of baggage
Clients must leave baggage at the specified time of pickup, at the pick-up point specified in the confirmation email or text message.
It is the responsibility of the customer who books the baggage transfer with Mont Blanc Bags, to ensure that the baggage is available to be collected at all times between 8am and 4pm.
Bags must be ready by 8 am for collection, with the baggage label provided by Mont Blanc Bags completed and attached.
Mont Blanc Bags will make every effort to ensure your baggage is collected and dropped off between the agreed time. However, should unforeseen circumstances such as vehicle breakdown, accident, road closure, weather, traffic conditions and changes in weather occur, delays may occur. In this event, Mont Blanc Bags will make alternate and arrangements that could result in the late arrival of luggage.
Mont Blanc Bags does not accept any consequential liability resulting from such late deliveries.
The customer must agree that drivers are able to use their discretion in the delivery of luggage should an accommodation be unstaffed on arrival. Exercising such discretion may require luggage to be dropped off in a porch/outhouse or other such suitable alternative that has been agreed with the accommodation provider without any liability against loss or damage on the part of Mont Blanc Bags.
If at the pickup time the baggage is not there, and the customer cannot be contacted, their booking will be automatically cancelled, and the passenger will not be entitled to a refund or compensations.
If the baggage is not labelled it will not be picked up by the drivers.
Customers must provide a telephone number at which they can be reached for the duration of the booking. If Mont Blanc Bags cannot reach customer, Mont Blanc Bags will not be held responsible for delays.
In the event that baggage is not available for collection, and a later repeat pick up is required, Mont Blanc Bags reserves the right to charge reasonable expenses incurred for having to repeat the journey or otherwise sub-contract the repeat journey to another service provider.
6. Loss or damage to luggage (Liability)
Mont Blanc Bags does not accept liability for any damage claims to bags or their contents, however we will of course take every care to ensure no damage results from our service.
Mont Blanc Bags recommend that you obtain fully comprehensive insurance in respect of your luggage and its contents.
Mont Blanc Bags will only compensate for damage for which it is being held responsible. If the amount of the damage is reasonably justified; in the absence of proof, the lump sum payable shall be the sum of €200 per passenger and compensation paid shall, in any event, be limited to the sum of €800.
Mont Blanc Bags can be held responsible for a lost or damaged suitcase/bag during transit for a value up to €800 (unless a prior declaration has been made), under the following conditions:
The passenger makes a claim within 3 days of the transfer occurring by recorded delivery letter
Claims for items must be justified by sending the original invoices/receipts as proof.
In the event of loss of or damage to, your luggage which is due to a breach of any of our obligations under the contract for Mont Blanc Bags service between you and us, including these Terms and Conditions, our liability for foreseeable loss of, or damage to your property, shall not exceed our insurance limits, as follows:
€2,000 per item of luggage effected for claims by you; or
€400 per item of luggage effected for claims by your insurer.
If you are a consumer you have certain statutory rights in the event that our services are defective, and you suffer loss or damage. Your statutory rights are not affected
Any complaints must be made within thirty days from the date of transport by email to: firstname.lastname@example.org
Complaints may only be considered when this procedure has been followed. Mont Blanc Bags will endeavour to respond within 7 days.
Mont Blanc Bags company’s representatives other than the directors are not entitled to promise refunds for any reason and Mont Blanc Bags will not be bound by any such promise.
8. Third parties and agents
Mont Blanc Bags reserves the right to make use of third-party companies or agents for subcontract transfers.
In this case, no additional cost will be applied to the Customer/Passenger.
Mont Blanc Bags will ensure that the contractor is properly insured.
The terms and conditions of the subcontractor will apply.
9. This is a legal binding contract/entire agreement
I have read and fully understand this agreement and am fully aware of its content and context. I understand that this is a legal contract and that this is a release of liability. In submitting this tour reservation and payment of my own free will, I agree to the terms and conditions set forth above.
The provisions of this booking govern the entire relationship between the client and Mont Blanc Bags. The customers acceptance of this ticket constitutes the customers consent to these provisions. These provisions supersede any oral or written representations. Any change in these provisions must be in writing and signed by the directors of Mont Blanc Bags.
10. Limitation of liability
If either of us fails to comply with the terms of the contract between you and us including these Terms and Conditions, neither of us shall be responsible for any losses that the other suffers as a result, except for those losses which we or you could reasonably foresee would result from the failure to comply with the terms of the contract.
Neither of us shall be responsible for losses that result from our failure to comply with the contract between us, including these Terms and Conditions, that fall into the following categories:
loss of opportunity
loss of a bargain
loss of anticipated savings; or
loss of data
Our obligations are to take reasonable skill and care to arrange for the provision of such services and facilities.
You must show that reasonable skill and care has not been used if you wish to make any claim.
You understand that we will not be liable where any failure in the performance of the contract is due to:
a third party unconnected with the provision of the Mont Blanc Bags arrangements and where the failure is unforeseeable or unavoidable;
unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised; or
an event which we or our suppliers, even with all due care, could not foresee or forestall.
You (the customer) accept Mont Blanc Bags are not able to check that all drivers that are sub-contracted to by Mont Blanc Bags, are complying with every legal requirement of the relevant enforcing authorities and that it is fully the responsibility of the self employed driver who is sub-contracted to, to ensure they are fully compliant with all relevant legal requirements in force at any particular time. This is because Mont Blanc Bags retain the ability to sub-contract to any particular self-employed driver or taxi driver in order to ensure the transfer occurs efficiently, and the customer accepts that it is not practicable or necessary for Mont Blanc Bags to carry out these checks.
Mont Blanc Bags may provide advice from time to time as required by you, the customer. However, you accept that Mont Blanc Bags is not liable in any way for any advice given by it or any of its sister companies, and that advice is just that - advice. Only you (the customer) is in full receipt of all of the background details and abilities of you and your party, and of any given situation whilst actually on holiday, and you accept therefore that it is only you that can determine which advice given by Mont Blanc Bags and its other businesses and interests is relevant and safe for you and any others in your party. Therefore, after any advice is dispensed by us, it is ultimately you (the customer) that retains full liability for your own decisions and actions.
Mont Blanc Bags agree to provide the service on the terms set out above for any bookings that are accepted by us (accepted meaning that we have confirmed by email or phone that your booking has been made). Our terms and conditions are otherwise subject to change at any time.
Mont Blanc Bags do not store financial information such as Bank Account or Card details.
Mont Blanc Bags shall not be held vicariously liable for the intentional or negligent acts of any persons not employed by Mont Blanc Bags nor for any intentional or negligent acts of the Mont Blanc Bags employees committed while off duty or outside the course and scope of their employment.
11. Law and jurisdiction
ALL claims suits and litigation of any kind whether against Mont Blanc Bags shall be brought in France.
These Conditions of Carriage shall be governed by the laws of France.
These Terms and Conditions are subject to French law. Any dispute relating thereto shall be brought before the relevant French courts.
Each party hereto irrevocably submits to the exclusive jurisdiction ……….in respect of any action, proceeding or litigation of any kind relating in any way to the customer or his luggage.
Any information supplied by the passenger is subject to the French law no 78-17 of the 6th January 1978 pertaining to “Technology and Freedom” Mont Blanc Bags will not communicate any client information to a third party without prior authorisation from that person. All personal information is treated confidentially. As per the French law no. 78-17 of the 5th January 1978, modified by the law no. 2004-081 of the 6th august 2004, each client has the right to access, modify and remove any details held about them and they have the right to request that all messaging be stopped.
Mont Blanc Bags terms and conditions are governed by French Law. Any dispute between MBB and a third party if not resolved amicably will be referred to a mediator. If this is unsuccessful then the matter will be referred to a French court.
